1. Definitions
“Client”: The person or organisation booking services
“Performer” / “We”: High Art
“Event”: The agreed performance engagement
2. Booking & Confirmation
All bookings are confirmed only upon written acceptance and receipt of any required deposit.
Verbal agreements are not binding.
Event details must be confirmed no later than 14 days before the event.
3. Fees & Payment
Fees are agreed in advance and confirmed in writing.
A non-refundable booking deposit may be required.
The remaining balance must be paid no later than 7 days before the event, unless otherwise agreed.
Late payments may result in cancellation.
4. Cancellations
a) Client cancellation
More than 60 days before event: deposit retained
30–59 days: up to 50% of total fee payable
Less than 30 days: 100% of agreed fee payable
This reflects loss of work and short-notice rebooking difficulty.
b) Performer cancellation
If we must cancel due to illness or force majeure:
We will make reasonable efforts to provide a suitable replacement, or
Provide a full refund of fees paid
No further liability applies.
5. Force Majeure
Neither party is liable for failure to perform due to events beyond reasonable control, including but not limited to:
Extreme weather
Government restrictions
Acts of God
Venue closures
6. Event Conditions & Client Responsibilities
The Client must ensure:
Safe and suitable performance area
Protection from weather for outdoor events
Reasonable access and setup time
Adequate power supply (if required)
We reserve the right to refuse to perform if conditions are unsafe.
7. Overtime
Performance times are agreed in advance.
Any overtime is subject to availability and charged at an agreed hourly rate.
8. Equipment & Damage
All equipment remains our property.
The Client is responsible for damage caused by guests, venue staff, or third parties.
We are not responsible for venue power failures or technical issues beyond our control.
9. Recordings & Media
Guests may take personal photos/videos.
Professional recording or live streaming requires prior written consent.
We may use event photos/videos for promotional purposes unless the Client objects in writing.
10. Limitation of Liability
Our liability is limited to the total fee paid for the event.
We are not liable for indirect or consequential losses.
Nothing in these terms limits liability where prohibited under Irish law.
11. Consumer Rights
Nothing in these terms affects your statutory rights under Irish consumer protection law.
12. Governing Law
These Terms & Conditions are governed by the laws of Ireland, and Irish courts have exclusive jurisdiction.
